This clarification text has been prepared by Sanctuary Family Wellness in accordance with Article 10 of the Personal Data Protection Law No. 6698 and the principles to fulfill the Obligation of Clarification as a data controller. Sanctuary Family Wellness reserves the right to update this Personal Data Protection Disclosure text in line with potential changes in the current legislation.

1. Legal Basis for Collecting Personal Data

Various laws contain regulations on the use of our customers' personal data. Primarily, the PDPL outlines the principles for protecting personal data. In addition, the Law No. 6563 on the Regulation of Electronic Commerce includes provisions on the protection of personal data. Certain criminal sanctions are also prescribed through the provisions of the Turkish Penal Code No. 5237 to protect personal data. Furthermore, obligations arising from the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts necessitate the collection and use of data.

2. Methods of Collecting Personal Data

The personal data in question is processed automatically, based on the legal grounds of "being necessary for the data controller to fulfill its legal obligation" and "being mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject" as stated in Article 5 of the Law.

3. Areas Where Personal Data is Used

The sharing of personal data belonging to our customers with third parties occurs within the framework of customer consent, and as a rule, personal data is not shared with third parties without customer consent. However, due to our legal obligations and within these limits, personal data may be shared with courts and other public institutions when necessary.

Your personal data may be shared with Sanctuary Family Wellness's shareholders, our domestic/foreign direct or indirect affiliates, institutions, and organizations with which we cooperate to carry out our activities, persons and institutions from whom we receive cloud storage services for data, and related business partners.

4. Rights of Our Customers under Article 11 of the Personal Data Protection Law:

Under the PDPL, regarding your personal data, you have the right to;
a) Learn whether personal data is processed,
b) Request information if personal data has been processed,
c) Learn the purpose of the processing of personal data and whether they are used in accordance with their purpose,
d) Know the third parties to whom personal data is transferred domestically or abroad,
e) Request correction of personal data if it is incomplete or incorrectly processed,
f) Request deletion or destruction of personal data,
g) Object to the occurrence of a result against the person himself/herself by analyzing the processed data exclusively through automated systems,
h) Request compensation if the person incurs damage due to the unlawful processing of personal data.
